Art. 1 – Organizer and Contacts

These regulations govern the skill competitions ("Skill Games") organized by Ovy B.V., a private limited company with its registered office in the Netherlands, registered with the Dutch Chamber of Commerce (KVK) under number 82018618, VAT (BTW) NL862306838B01 (hereinafter "Organizer" or "Company").

Art. 2 – Territorial and Legal Scope

Competitions are accessible to users residing in the European Union and in countries where participation in online Skill Games is not prohibited by local law. The user is solely responsible for verifying the legality of their participation based on the laws of their country of residence.

Art. 3 – Participation Requirements and Prohibitions

Only natural persons who meet the following criteria may participate:

  • Have reached the age of 18 at the time of registration.

  • Are regularly registered on the Site with truthful data.

  • Are not employees of the Organizer or their direct family members.

  • Bot Prohibition: The use of automatic software, bots, scripts, or macros to analyze images or place entries is strictly prohibited. Violation results in immediate account cancellation and forfeiture of any winnings.

Art. 4 – Gameplay and Determination of the Winner

Participation takes place via the "Spot the Ball" (Identify the object) method:

  • AI Processing: All game images are processed using Artificial Intelligence (AI) software and advanced graphic editing for the sole purpose of digitally removing the game object (e.g., the ball) from the scene.

  • Winning Coordinates (Objective Proof): To ensure maximum impartiality, there are no subjective juries in this phase. The winning coordinates (X, Y) are determined mathematically and objectively: they correspond exactly to the center position of the object in the original, unmodified photograph.

  • Victory: The winner is the user whose click is closest to the original coordinates of the object ("Lower Delta"). At the end of the competition, the Organizer will make the original photo available to demonstrate the correctness of the result (Total Transparency).

Art. 5 – Subscriptions and Purchase Limits

To ensure responsible gaming and reward loyalty:

  • FREE Users (No Subscription): Can purchase a maximum of 5 total Tickets. Once this limit is reached, further purchases are blocked by the system until a plan is subscribed.

  • MEMBER Users (Player, Pro, Elite): Purchase limits are removed, and they can participate with unlimited tickets to maximize their chances of success based on skill.

    Subscriptions renew automatically unless cancelled, which can be done at any time from the user profile.

Art. 6 – Prizes and "Cash Alternative" Clause

Prizes are indicated on the page of each competition.

Minimum Participants Rule: If a competition does not reach the minimum number of tickets sold (Target) by the deadline, the contest is NOT cancelled. The competition concludes regularly, and the winner is determined by skill.

However, in this specific case, the winner will receive a Cash Prize ("Cash Alternative") equal to 70% of the net value of the tickets sold for that competition, instead of the physical prize. The remaining 30% is retained by the Organizer for management and marketing costs.

Art. 7 – Assignment and Shipping

Winners will be notified via email at the address associated with their account. To ensure correct delivery, the winner must confirm the shipping address within 7 days of notification.

Age and Identity Verification: To ensure compliance with the prohibition of gambling by minors, the Organizer reserves the right to request proof of age (e.g., a redacted copy of a document) before shipping, especially for high-value prizes (exceeding €100) or for the disbursement of the Cash Option. In case of failure to verify or if the user is a minor, the prize will not be awarded.

Shipping costs are covered by the Organizer for deliveries within the EU.

Art. 8 – Right of Withdrawal and Refunds

By purchasing a Ticket, the user is purchasing digital content with immediate execution.

In accordance with the EU Consumer Rights Directive, the user expressly agrees to lose the right of withdrawal (14-day refund) at the moment the Ticket is used or the competition begins.

Tickets are non-refundable except in the event of total cancellation of the contest by the Organizer.

Art. 9 – Privacy and Advertising

By participating, the user accepts our Privacy Policy. In the event of a win, the user consents to the publication of their Nickname and the Amount/Prize won on the Organizer's website and social media, for purposes of transparency and to guarantee Fair Play to the community.

Art. 10 – Applicable Law

This contract is governed by the laws of the Netherlands. For any dispute, the competent Court at the Organizer's headquarters shall have exclusive jurisdiction, subject to the mandatory consumer rights provided by EU regulations.
